1. DEFINITIONS
1.1 "Company" refers to Infinity Mobile NV, who is the entity that developed and designed the ecommerce platform Sayl Retail. Infinity Mobile is registered in Belgium, VAT No. BE0640.980.849
1.2 "Customer" refers to any person, firm, company or unincorporated association which subscribes to the Service "Sayl Retail".
1.3 "Customer Content" is data, information, file attachments, text, images, personally identifiable information, and other content that is uploaded or submitted by users or collected by users from third parties using Forms or other features of the service.
1.4 "End User" is a user of Customer's mobile webshop/pop-up shop created in the Sayl Retail system.
2. INTRODUCTION
2.1 The Company is committed to protecting the privacy of all visitors to our website or services through www.shopitag.com, or through the pop-up shops created on the Sayl Retail platform and available in different channels as chatbots, e-mail, websites etc…(together, "the Services"). The following privacy policy explains how we use and protect your information.

2.2 By visiting or using the Services, you agree and where required you consent to the collection, use and transfer of your information as set out in this policy. By using our Services as a Customer, you agree with our EU Data Processing Addendum.
3. INFORMATION THAT WE COLLECT FROM YOU
3.1 When visiting or making an order through the Services, you may be asked to provide information about yourself including details such as your name and contact details. We will never ask or store your payment information, this is done on the platform of the payment providers that are linked to Sayl Retail. We may also collect information about your usage of the Services and information about you from the messages you post to our Services and the emails or letters you send to us.

3.2 When accessing our website information and/or services using mobile digital routes such as mobile, tablet or other devices/technology including mobile applications, the Company's data collection and usage as set out in this privacy policy will apply in that context too. Technical information from your mobile device or your use of our services through a mobile device, for example, location data and certain characteristics of, and performance data about your device, carrier/operating system including device and connection type, IP address, mobile payment methods, interaction with other retail technology such as use of NFC Tags, QR Codes or use of mobile vouchers may also be collected.
4. WHAT WE DO
4.1 In providing the Services, Company may engage sub-processors to process Customer Content, including, without limitation, any associated Personal Information pursuant to this Agreement within the European Economic Area, the United States and in other countries and territories.

4.2 Your information may be used to contact you for your opinions on our services and to inform you about significant changes or developments to our Services.

4.3 The Company collects, stores, uses and accesses Customer Content to maintain, improve and support the Services. The Company may also use Customer Content in an encrypted and aggregated form ("Aggregated Data") for Infinity Mobile's own business purposes, including use, duplication, modification and creation of derivative works regarding usage and performance of Aggregated Data which does not directly or indirectly identify Customer or End Users. The Company shall own all right, title and interest to the Aggregated Data and any derivative works thereof. The Company only shares Customer Content with others under special circumstances as follows:

  • a. With third parties who work on the Company's behalf to provide the Services;
  • b. To the extent needed to comply with laws or to respond to lawful requests and legal process (provided that the Company will endeavor to notify Customer if Infinity Mobile has received a lawful request for Customer's information);
  • c. To protect the rights and property of the Company, its agents, customers, and others including to enforce Infinity Mobile's agreements, policies, and terms of use;
  • d. In an emergency, including to protect the personal safety of any person;
  • e. In connection with a sale or transfer of all or a part of the Company's business or assets (business deals may include, for example, any merger, financing, acquisition, divestiture, or bankruptcy transaction or proceeding); or
  • f. As directed by Customer, including through its use of the Services.
5. RIGHT TO FORGET / OPT-OUT
The Company provides Customer with access to Customer Content and the ability to delete Customer Content upon request. This request can be initiated via following page. Upon cessation of Infinity Mobile's relationship with Customer, Infinity Mobile may delete Customer Content no longer in active use. The Company agrees to maintain commercially reasonable technical and organizational measures designed to safeguard Customer Content from unauthorized access, use or disclosure. These will include measures designed to: (i) store Customer Content on servers located in a physically secured location and (ii) use firewalls, access controls and similar security technology designed to protect Customer Content from unauthorized disclosure. The Company takes no responsibility and assumes no liability for any Customer Content other than its express security obligations in this section.
6. DISCLOSURE OF YOUR INFORMATION
6.1 The information you provide to us will be transferred to and stored on servers in Europe.

6.2 Those third parties process information such as credit card payments and provide support services for us. In addition, we may need to provide your information to any Partner Merchants that you have placed your order with. By submitting your personal data, you agree to this transfer, storing or processing. The Company will take all steps reasonably required to ensure that your data is treated securely and in agreement with this privacy policy.

6.3 If our business enters into a joint venture with, purchases or is sold to or merged with another business entity, your information may be disclosed or transferred to the target company, our new business partners or owners or their advisors.

6.4 We may use the information that you provide to us if we are under an obligation to disclose or share your information in order to comply with (and/or where we believe we are under an obligation to comply with) any legal obligation; or in order to enforce our Application Terms and any other agreement; or to protect the rights of the Company, Partner Merchants or others. This includes exchanging information with other companies and other organizations for the purposes of fraud protection and prevention.
7. SECURITY AND DATA RETENTION
7.1 We take steps to guard your information from unauthorised access and against unlawful processing, accidental loss, destruction and damage. We will keep your information for a reasonable period or as long as the law requires.

7.2 Where you have chosen a password which allows you to access certain parts of our Services, you are responsible for keeping this password confidential. We strongly suggest you do not share your password with anyone.
